TERMS OF SERVICES FOR CUSTOMERS:

YOGLIVING is an unique intermediary platform for those seeking physical and mental wellness through yogic activities. YOGLIVING connects such desirous persons on line with reputed, experienced and genuine yogic retreat providers in India and abroad.

In order to ensure consistent and better experience with YOGLIVING, we expect our valued visitors on the portal to adhere to and accept following terms of use by customers.

  1. We do not take any responsibility for any errors, omissions,inaccuracy of any data provided by service providers -retreat providers.
  2. We do not take any responsibility for tempering with the data, cyber attack or disruptive virus on the platform though we take every possible care for prevention of such disruption.
  3. Use of platform is on ‘as is where is basis ‘use at your responsibility
  4. YOGLIVING do not recommend, endorse or suggest selection of services, products or facilities of any yogic retreat providers nor guarantee ab out the performance, efficacy quality or efficiency of services products facilities provided by various yogic retreat providers.
  5. Selection of any retreat providers will solely at the discretion of customers desirous of availing yogic retreat and we shall not be a party to terms and conditions agreed between you and yogic retreat providers. We also do not guarantee performance of any terms and conditions agreed between customers and retreat providers.
  6. Customers will adhere to all KYC norms required by the platform and retreat providers from time to time. All customers desirous of availing yogic retreat from any of the yogic retreat providers shall have to sign up an account with furnishing required details with the YOGICLIVING.
  7. Customers desirous of availing yogic retreat from abroad yogic retreat providers shall have to comply with all foreign exchange regulations and RBI guidelines.
  8. Customers need to above 18 years of age to use the YOGLIVING.
  9. Customers will be required to follow and observe the terms and conditions of all types of selected retreat providers.
  10. Customers shall not indulge in fakebooking, money laundering and any other criminal activities bares by the law of the land while using YOGLIVING us.
  11. Customers shall not tamper with the software and data in YOGLIVING in any manner.
  12. Prior to booking the selected yogi retreat customers are required to go through the terms and conditions of the retreat providers in details particularly prices ,period, taxes etc to avoid misunderstanding or communication gap.
  13. Prices offered on the platform may be provisional particularly that of retreat providers abroad
  14. Customers are also required to go through the cancellation and refund of paid amount policies of retreat providers carefully. The YOGLIVING shall not be responsible for any dispute in this regard the customer would directly deal with the respective retreat provider and in situation of dispute with the retreat providers , YOGLIVING shall not be made party to any suite or court case.
  15. YOGLIVING and its promoters reserve their right to make any changes, deletion in the data or software of the platform at their sole discretion without giving any notice to the public or customers.
  16. Customers shall be solely responsible for the contents of data submitted on the platform and review made on the plat form in respect of any retreat provider.
  17. The contents referred to under item 16 shall be in lawful manner without infringement of YOGLIVINGs intellectual property rights or privacy policy.
  18. In order to make use of the Platform it is required that you provide Acme Infosoft with personal information such as your name and e-mail address.

    19. "We take your privacy very seriously. We only gather (personal) data for the purpose of providing you the service you need. We take appropriate measures to safeguard your personal data. After making a reservation the trip organizer is responsible for handling of your personal

  19. All rights in the platform technical, IT,contents,trademark,design and appearance lay out of the portal are owned by YOGLIVING and ACME Infosoft.
  20. Use of YOGLIVING for the purpose of other than its intended purpose is strictly prohibited. Excessive searches, extraction data for prices of other information and such other purpose uses which puts stress on he portal is strictly prohibited and shall be viewed seriously for taking legal action.
  21. Contents or images, photos uploaded by customers shall be strictly as per our norms and the same will no contain any objectionable, immoral or unlawful contents or images. And the same shall not infringe the privacy rights of other parties. You accept full responsibility for any legal matter against YOGLIVING at ACME Infosoft. You also agree to indemnify the YOIGILIVING OR ACME Infosoft for any damages or losses or liability arising from such legal action.

  23. Limit of Liability:

    In the event of deficiency in service on our part proved beyond doubts,we shall be liable for costs incurred by you and allowed by the consumer courts in India. We shall not be liable in any case for indirect,or consequential loss or damages or costs and also force majeure cases beyond our control.

    We shall not be liable for breach of any terms and condition or deficiency in service on the part of retreat provider.

  24. All disputes or legal matters subject to Ahmedabad Gujarat India Jurisdiction as per Indian laws.

Booking and Payment:

  1. 1.1. Retreat organizers are required to pay a registration fee of INR 2500 to YogLiving (Acme Infosoft) for each separate location listed as a center on the platform.
  2. 1.2. Additionally, YogLiving (Acme Infosoft) will charge a service and conveyance fee of 15% on the total booking amount for each retreat organized through the platform.
  3. 1.3. The 15% service and conveyance fee collected by YogLiving (Acme Infosoft) is non-refundable and serves as compensation for the platform's services.

Organizer's Responsibilities:

  1. 2.1. Retreat organizers are responsible for providing accurate and updated information about the retreats, including dates, location, activities, and accommodations.
  2. 2.2. Organizers must ensure the quality, safety, and integrity of the retreat experience, including accommodations, facilities, and activities.
  3. 2.3. Any issues, disputes, or problems that arise during or after the retreat are the responsibility of the organizer to resolve in a timely and satisfactory manner.

Property Issues:

  1. 3.1. Retreat organizers are liable for any issues related to the property, facilities, or accommodations provided during the retreat.
  2. 3.2. Participants should address any complaints or concerns regarding the property directly to the retreat organizer for resolution.
  3. 3.3. Organizers are responsible for providing refunds or compensation for any property-related issues that significantly impact the participant experience.

Participant Responsibilities:

  1. 4.1. Participants are responsible for adhering to the rules, regulations, and guidelines set by the retreat organizer.
  2. 4.2. Participants must meet any prerequisites or requirements specified by the organizer for participation in the retreat.
  3. 4.3. Participants are liable for any damages caused to the property or facilities during the retreat and may be responsible for repair or replacement costs.

Cancellation and Refunds:

  1. 5.1. Organizers must provide a clear and fair cancellation policy to participants, outlining any fees or penalties for cancellations.
  2. 5.2. Refunds for cancellations made by participants should be provided in accordance with the organizer's cancellation policy.
  3. 5.3. The 15% service and conveyance fee charged by YogLiving (Acme Infosoft) on the booking amount will not be refunded to participants in the event of cancellation.

Indemnification:

  1. 6.1. By organizing a retreat and accepting participants, organizers agree to indemnify and hold harmless YogLiving from any liabilities, damages, losses, or expenses incurred as a result of the retreat.

Governing Law:

  1. 7.1. These terms and conditions are governed by and construed in accordance with the laws of Ahmedabad, India, without regard to its conflict of law principles.

Modification of Terms:

  1. 8.1. Retreat organizers reserve the right to modify these terms and conditions at any time with prior notice to participants. Changes will be effective immediately upon notification.

By organizing a retreat and listing it on YogLiving's platform, organizers acknowledge that they have read, understood, and agreed to abide by these terms and conditions.
